The remedies for stagnation of investigations in the “Cartabia” reform, between protection of legality and gigantism of the Prosecutor’s offices
ABSTRACT
Among the tools introduced by the “Cartabia” reform to restore the guarantee of legality in investigations, the most convincing is represented by the “jurisdictional window”, which allows the judge to intervene at the request of the parties to remedy the prosecutor’s inertia. The effectiveness of the mechanism, however, is compromised by the exercise of the powers attributed to the Attorney General, which can hinder the judge’s control and lengthen the investigation times. A “boomerang effect”, which the legislator intends to remedy with a corrective decree soon to be published.
